The NSA does not tap US phones. The FBI (and state & local police) does - with court order. All court orders for taps are and have always been clandestine/confidential, whether you're thought to be a terrorist, a Mafioso or Joe bank robber. Clandestine court orders remain confidential for the duration of the investigation. Judges will not accept never ending investigations to keep records confidential.

The NSA does not tap foreign phones. The CIA does. ALL governments do this. The NSA constructs and contracts to construct cryptographic equipment, provides daily keys for said equipment and governs their use. The NSA listens to foreign radio (RF) broadcasts from around the world (both from inside the US and from inside other countries with their permission) and decrypts encoded information. In addition to this, the NSA collects other RF emissions (such radar signatures, etc.) to identify and characterize the capabilities and locations of the equipment. Neither the NSA nor the CIA operate overhead (satellite) equipment. The NRO (National Reconnaissance Office) does this. The CIA & NSA would be users of this information. Regardless of the misinformation we've all heard, the NSA does not tap domestic phones and would only get involved in anyone's telephone or computer traffic when asked to attempt to decrypt court warranted information for the FBI, Secret service, DEA, State or local police as asked.

Amendment IV is the pertinent Amendment...

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Nothing in this 4th Amendment requires the warrants to be public such that criminals can know their phones are being tapped or that their abodes have been searched. The warrants must be presented if searchers are challenged, as it is the only defense against government searches and seizures.

I don't understand why all this sudden whining regarding federal phone and email snooping. It has been in place for years. Doesn't anyone remembers Algore's "Clipper chip" endeavor of 1993 or the CALEA (communications Assistance for Law Enforcement Act of 1994) of the Clintinesta regime.

The NSA , the National Security Agency (otherwise known as "No Such Agency") has tapped phones world wide with huge installations in Canada, covering eastern Russia and the north pacific, UK for the north Atlantic and western Europe, Turkey, covering the middle east, and Australia and New Zealand for Pacific Rim coverage.

There has been a special secret court authorizing clandestine "National Security" wire taps for years which has never refused an FBI request tap request, ever. This isn't black helicopter and blue helmat conspiracy nonsense, it is fact. Enter clipper chip and calea on any search engine for literally millions of articles.

It is amazing how the libdem media was able to ignore fifteen years ago what it now severely castigates the Bush administration for today.
