Good question. Perhaps it would something else in addition to a photograph. For example, if it were discovered that you asked around for drawings of power plants, researched bomb making, and you had a photograph of some plant's security, you might come under suspicion.
You could be a writer researching a book. Or you could be someone with a strange interest in power plants, poisons, bombs, and the like. You know you are innocent, but should they tear your life apart?
The question seems to be this: when should the government open a file and start looking at your records? In this case, your camera phone transmissions. What happen if you take pictures of some power plant that is later blown to bits and they discover that you innocently took photographs the day before?
