Not having open source is discrimination? How so? Sounds like a stretch of the definition to me.
Discriminating: to make a difference in treatment or favor on a basis other than individual merit <discriminate in favor of your friends> <discriminate against a certain nationality>
To say that not providing source code is discrimination doesn't really fly.
