No so fast!  Per what Max had written, legal had approved the EULA.
What he wrote then didn't apply to the Firstboot text.  So I asked.

Now we know this is true, so I'm no longer concerned, and I'll go
study copyrights on collections, since my lack of knowledge on this
topic is showing ;-)
