No so fast!  Per what Max had written, legal had approved the EULA.
What he wrote then didn't apply to the Firstboot text.  So I asked.

The legal team for the company you work for has approved this.

Now we know this is true, so I'm no longer concerned, and I'll go
study copyrights on collections, since my lack of knowledge on this
topic is showing ;-)

I've sent Mark a note with some of the comments in this thread, and if he wants to recommend any changes to firstboot or EULA text, he will.
