I think legal "uncertainties" could be avoided if the driver would be GPL compatible (Dual MIT/GPL). It should allow upstream inclusion and Linux distributions could pick it up. Making your existing customers happy could be such an opportunity ;) None of the three server vendors I checked did offer Advanced-8 8GB HBAs.
