1) this isn't what I think of as a watermark. To me a watermark is what one sees when you hold a US $50.00 note up and see Grant.
2) they are not putting a copyright symbols on the photo so they are not getting any copyright protection. They are just saying they are the source of this item. It really isn't even a derivative work as it is just a copy of an existing work.
3) the copyright holder can sue them for $ if they didn't receive permission to publish them from the copyright holder.

The photos are owned by Museo de Oro. A man photographed them and put them in cdodev.com. The photos are also watermarked "CDOdev.com". When I wrote a complaint about this practice, one photographer explained that although the original photo is owned by Museo de Oro, the photos of these photos are made by CDOdev.com and deserves to be watermarked because these copies are owned by CDOdev.com.
