Pablo,

I guess that would make a lot of sense to someone used to dealing with taxes and such!! As for identity theft ... I have to submit a W9 to companies in the US that pay for a license. So this being a reputable firm in Romania I doubt is identity theft but you are right they would have some personal info - much like the W9 form requested in the US. To clarify, this company has used my image for the last ten years as part of a license they paid for at that time. They want to continue using it for another ten yeras. That is where the transaction is at this time. FYI the fee we are talking about is $3000 Euros.

Once I got paid by an outfit in France. The French taxes on the transaction amounted to about 1/2 the $180 fee. Then I had to deal with the US bank cashing a French cheque. In the end there was not much left for me!

So, I am in a quandary ... I think the legal thing to do is to send them the 6166, no? It would cost me $85 to get that form. I don't think the company uses PayPal. I could ask. But then what?

Something to think about. Ideas? Suggestions?

Andy

That form is to prevent double taxation when you get money from abroad
However they shoul dnot be asking for it, and you should ask for a tax certificate if they charge you any.
Ask them to pay via PayPal and send you a tax - receipt if they charged you any on their end so you can claim a credit on the income tax in ht eUS

Form 8802 is used to request Form 6166, a letter of U.S. residency certification for purposes of claiming benefits under an income tax treaty or VAT exemption. You cannot use Form 6166 to substantiate that U.S. taxes were paid for purposes of claiming a foreign tax credit.

You cannot claim a foreign tax credit to reduce your U.S. tax liability with respect to foreign taxes that have been reduced or eliminated by reason of a treaty. If you receive a refund of foreign taxes paid with the benefit of Form 6166, you may need to file an amended return with the IRS adjusting any foreign tax credits previously claimed for those taxes.

It sounds to me like the next things they want are your bank account numbers. Are you certain they are not calling from NIgeria?

Dear friends,

I am about to be a fortunate recipient of a princely fee from a group in Romania that wants to use one of my photographs for a marketing campaign. Preliminary to the payment of the fee they asked for a US Certificate of Residency - IRS form 8802/6166 .... does anyone on the list know what this is all about?

Thank you for whatever free assistance you can provide. ;)
