For that reason I have removed all his quotes from my website. I need your help what can I do - doesn't I have some right to publish them cause it is in educational purposes and is posted under the Fair Use Provision of the Copyright Act?
As an educator, I represent one of the largest groups of professionals that violate copyright laws with respect to photocopying alone. Purpose of use makes little difference. It's purpose of sale. If a publisher distributes a copyrighted good to a school or district, this district is given strict limitations with respect to any reproduction (worksheets, lesson plans, manipulatives, etc). Technically, it is illegal for a district to photocopy a text it has purchased, but has not enough for its students. Students can photocopy pages from a book for purposes of research. But teachers photocopying pages from a book make librarians nervous!
However, I've often heard that nonprofit organizations are given relative free license to use materials as they choose. When I worked in radio in college, we blatantly, under the supervision of the FCC (not that their concerns are even remotely copyright related), used copyrighted materials for fundraising and advertising purposes. I wonder why public schools don't get the same leeway?
Anyhow, what can you do? Kiss his ass, maybe, and hope he gives you permission. Or, see if he has a good enough lawyer.
