It's a build fix in that there's only supposed to be the one copy of those utilities in the tree, and that is what musb should be using -- on all platforms. You might be happier thinking of this as fixing two deeply related bugs with one patch. In no way is this "before its time"; both of those bugs should have been addressed by the patches which created and populated drivers/usb/otg.
