I think "for port == NETXEN_NIU_MAX_XG_PORTS"  error should be returned.

Yes error should be returned for  both port == NETXEN_NIU_MAX_XG_PORTS and
port ==  NETXEN_NIU_MAX_GBE_PORTS.
