If the two collaborated on the actual patch this would be appropriate.

But, if you, Jens, created this patch based on some previous work by
Merck's I find it perfectly appropriate to list yourself as author,
Sign-off-by according to developer certification of origin 1.1 b ("The
contribution is based upon previous work that..."), and give Merck
credit for his work as you do here.

The first certificate of origin of the patch, should however match the
author. So you should either drop this, keep Merck as the author, or if
the two of you collaborated add a Co-developed-by - as suggested by
Nikita.
