Potentially yes.

If 1) and 2) right - isnt this an idle period scenario?

It is an idle period scenario but looking through RFC3448 for idle I
don't know if this one was envisaged as they don't mention it.
Remember on a LAN this could knock back your rate in less than 1
millisecond.

Or are u dropping packets in the middle after the sender has sent it?
