Not exactly. You can very well contribute code that is shackled by
patents under many Free software and open source licenses which has no
patent provisions in them such as the BSD or MIT license which
significant parts of Mono is licensed under. If Novell contributes any
such code under these licenses they would currently be shielded from any
patent infringement claims from Microsoft for the term of the Microsoft
<-> Novell agreement but anyone else cannot.
