You are right, the license simply addressed contract agreements and more or less the copyrights. It is possible that ntfs-3g's current implementation under user level, rather than at the kernel level, and assuming it was developed under the clean environment, merit the idea as distinct and beyond the scope of ntfs patent that has been granted.
