I.e., it is enough to justify a lawsuit if the publisher feels like it.

I'm sorry, I know you all just do your best, but isn't this sad?  Now
that the digital millenium is really starting, and it seems like
eBooks start to be the way and not everyone needs to OCR on his own
anymore, now do we get such a "solution", offering us further
problems.
