Wrong. the hypothetical non-GPL plugin owner would have to prove even
though it's digging deeply within gstreamer insternals it's not a
gstreamer derivative and the GPL does not apply to the pluggin code

What fluendo did is grant itself the permission to release and have
distributed derivative code not bound by the gstreamer license (because
FLOSS obligations are incompatible with the video patent regimes out
there)
