I'm not a CVS guru, but what about just moving the email sending to the
commitinfo file instead of the loginfo file (After the acl checks). 

commitinfo is run before the files are commited, so if they stopped it,
then they would have no commited files. It might be that there is less
info available at that point, but I would fine also with 2 emails... 

user foo is about to commit bar/baz.spec bar/baz.patch
then
user foo commited bar/baz.spec bar/baz.patch with changelog: "whatever"

I'm probibly missing something, but won't that work?
