Usually the second one applies. This is because the original the paths in the diff-file have a prefix to distinguish the original from the patched version (for example the paths begin with a/ and b/). To apply the patch this prefix has to be removed from the path (since you apply the patch directly in the source folder). The number after the -p option defines how many slashes (/) are contained in the prefix that needs to be stripped (say n). The prefix will be stripped to the n-th slash.
