[VLAN] unregister_netdevice

Hello list,
I have a problem with two vlan interfaces on one NIC
under load about 120-140mbit.
My network script is 'ip' based (not 'ifconfig')
and when I do ifdown-ifup, very often I have the following:

Jul 10 20:49:41 Anakin kernel: unregister_netdevice: waiting for 
eth0.778 to become free. Usage count = 1
Jul 10 20:50:12 Anakin last message repeated 3 times
Jul 10 20:51:12 Anakin last message repeated 6 times
Jul 10 20:52:12 Anakin last message repeated 6 times
Jul 10 20:53:12 Anakin last message repeated 6 times
Jul 10 20:54:12 Anakin last message repeated 6 times

After this the system hangs up.
My question is:
Can I avoid this situation somehow? And where is the problem
in my NICs: 3Com Gigabit NIC (3C2000)
or in vlan module?
The current kernel version is 2.6.12.2, and the problem is from 2.6.9.
Any suggestions are welcome
