They are not lock files, but rather files that contain lock names.

See the locks by doing
    cd /var/lib/rpm
    /usr/lib/rpm/rpmdb_stat -CA

rpmdb_stat is just db_stat from db4-utils, see doco at www.sleppycat.com
or in the db4-utils package.

Yes, the __db* files are persistent.

Yes, there should be no locks displayed when rpm -s not running.
