included the mod_ssl definetion
<IfModule mod_ssl.c>
      .....
</IfModule>

[root@linux4 html]# /etc/rc.d/init.d/httpd restart
Stopping httpd: [  OK  ]
Starting httpd: [  OK  ]
[root@linux4 html]# locate mod_ssl
/usr/include/httpd/mod_ssl.h
/var/www/manual/mod/mod_ssl.html

it works now...
