Fb doesnt Own the image so any use by a third party is a violation and actionable. Images being stilen is not new. Im sure others can attest to getting portfolios back with chromes retaped back into mattes. There are services like digi mark if its real concern for anyone.

Their Terms and Conditions are legal. They track every other web site you visit and create a behavioral profile that they sell to all comers.
