All I can say is that it's going to be a very interesting set of
court cases, touching upon and probably clarifying a number of
problematic issues in the current law.
Clearly some questions that I'm looking forward to seeing the answers to are:
To whom does the image file belong?
Did the artist use a hi-rez version of the file?
Did the owner knowingly permit the artist to acquire the hi-rez file?
What are the liabilities of those who helped him get the file - by
accident or intentionally - whatever resolution the file was?
(Google, Gannett, Murdoch, WaPo, NYT, Tribune etc)?
Is this fair use?
