I don't think the issue is that people are being photographed in less than modest conditions.  I think the issue, and grounds for government action, is the ensuing flood of litigation that binds up the court system and represents a strain on the efficiency of the system to address more important issues.  However, I do believe it would be more efficient to allow such activity rather than spend effort and money to enforce such legislation.  Perhaps fewer people would feel as comfortable "whipping it out" in public and would spare the rest of us their lack of modesty.  It might also keep those freakish celebs behind closed doors where they belong!

If the answer is 'the person' unless he/she gives away ownership completely, then the aggrieved subject can find a remedy in the civil courts. This would also apply if the subject set some limit on the republication rights by specifying how the photo can be used.

 

 

Secret photography - photographs taken in changing rooms at gyms, swimming pools etc

must be regarded as wrong because people choosing to use changing rooms and cubicles do so because they want privacy. Scotsmen who wear kilts are entitled to keep secret of whether they are wearing Y front or jock straps as also women who wear skirts and dresses.

A celeb or Cinderella who chooses to go to the ball without wearing a skirt has no grounds for complaint if someone takes of photo of her knickers. If someone lies out in the sun topless in private property be she a starlet or a granny she is entitled to similar privacy as if she was in a cubicle at a pool, but if she sits out on a public beach in a state of undressthen she has given up her claim to privacy.
