Generally speaking, salaries are whatever is negotiated between the employee in the company, so there's nothing illegal or immoral about that. That's why salaries for a given position are defined as a range. The reason why h1b employees tend to earn somewhat less is complicated. It's a much bigger deal for them to switch jobs than u.s. citizens, and that affects their negotiating position.
