Wifi bug or broken N800 ?

Today I flashed the RX-34_DIABLO_5.2008.43-7_PR_MR0 image to my N800. 
After the reboot I have configured to use a phone to get the Internet 
access via bluetooth. The process go well, but when I try to connect to 
the Internet, the connection box take very long to display and when it 
finally show, it's just an empty box. Then I observed that the Wifi is 
not functional at all. Using "dmesg" in the xterm show this kind of things:

cx3110x: WARNING fw_upload not allowed to DMA write.
cx3110x: **** WLAN registers ****
[...] All the registers show zero value.
cx3110x: ERROR failed to load 3826.arm.

Is that a software issue or a failed device ?
