So I have to apologize.  I took your idea about the firmware on the
harddrive and looked into it.  Sure enough there was a firmware update
that fixed the energy saving mode.  That made things happy again.

Using, the latest kernel plus your patches made suspend/resume work back
into super speed mode.  Using just the latest code without your patches
made suspend/resume work back into high speed mode (usb2).

I guess I didn't completely waste your time, but I will still apologize if
I made you pull your hair out trying to figure out what was going on. :-)

Hopefully, those patches will make their way upstream soon!
