Is it all understood why/how I never had any problems using a 3.5
kernel?(under Ubuntu 12.10).  I've only had this issue when running OpenElec
with 3.13-rc8.

If it's a hardware problem it must have been avoided or worked around either
by virtue of the older kernel or by some ubuntu-specific setting...
