Yes, since sometime during the 2.6.xx early development the memory management allocation routines were moved and registrations which took place earlier in the sequence failed because of no available kmalloc() yet. That is also why softsynth will not register when built-in to the kernel as the default synth. It is on my extensive list of projects or problems depending on how you look at it, to look into. Unless you depend on /dev/synth which very few folks do it has no ill affect. If you do need it for some reason then currently you're better off staying with a 2.4.xx kernel.
