How about

	if (mem_cgroup_prepare_migration(..)) {
		rc = -ENOMEM;
		goto unlock;
	}

?

Re-setting "rc" to -EAGAIN is not necessary in this case.
"if (mem_cgroup_...)" is commonly used in many places.
