Hmm. Your question seems fine to me and the answer seems clear.  Quote their email in the
description for the patch so we have it recorded in the git archive.

So I think we are fine, but as ever I'm not a lawyer.  Perhaps send them an advance
copy of the code and ask them confirm that they are happy for it to be included in
the mainline kernel under GPL v2?

That should make it clear exactly what code is covered etc.
