highpoint rr622 ext. SATA controller, regression post 2.6.38

bug # 37642

was recognize in 2.6.38, not in 3.0 or 3.1 using ubuntu kernels, tried
with upstream, same behaviour.  As per original send, asked for lspci
-nn output:
