It's probably easiest to use a newer kernel (2.6.13 or up), but you can
certainly apply the patch to an 2.6.12 (or lower?)

I have never used the v4l-dvb tree nor Mercurial, so I'm afraid I can't
advise you on this. I 'grew up' on the old-style 2.4 'DVB' driver, and
eventually moved to the in-kernel driver in 2.6.
