Indeed, the criterion should not be what language the code is in (pseudocode being a not-so-well-defined language, but still a language), but whether the code is intended to be (1) an illustration or to be (2) a template that can be used in implementation.  Note that “real code” often also needs massaging before it can be used in an implementation.  The illustration is fine with a documentation license, but the template needs a code license.  (Of course, some code is dual use; test vectors for example are often both illustration and code, so they need a code license.)
