I think Mike did a good job in confusing the facts, and maybe the
explanations from NomCom chair also do not correctly describe what
IMHO happened:

Luigi simply declared that he can not serve, and NomCom chair
had to take the 12th hashed candidate. Where and how is the
reason for declaring that one does not want to serve an aspect
in changing the process for selecting the next candidate from the
list ? I can't find anything about this in he rules. What if
Luigi had said he can not serve without explaining his employer
change ?

Now, if Luigi had said he wanted to serve, and now he works
for Huawei, then i guess NomCom chair would have had the
freedom to decide whether to remove Tal or Luigi. But in either
case this would not change that Tony would be the next one on
the list.
