So while that may cause a different handling in the vendor kernel in mainline you just cause the driver to not set any pinctrl setting at all. Aka the pin settings stay at what they are when coming from the bootloader. So maybe you just need to compare the state the pin is on in comparison to what the new (failing?) pinctrl setting is doing.
