Judge rules Sky Harbor's resurfacing will continue PHOENIX (AP) =97 A federal judge on Friday denied Tempe's request for an=20 injunction to stop work on a repaving project of Phoenix Sky Harbor=20 International Airport's center runway. The city of Tempe said the $60=20 million project would aggravate pollution and asked a U.S. District Court=20 in Washington to stop Sky Harbor from pouring concrete over the runway's=20 asphalt. Judge John Bates ruled that Tempe didn't establish that it would suffer=20 irreparable harm from the resurfacing. "The court, in one day, with one=20 presentation, in a couple of hours, they heard the case and ruled on it=20 right there, that it was completely without merit," said Phoenix Mayor Skip= =20 Rimsza. "The (Federal Aviation Administration) and the airport did all the= =20 environmental studies that were required for this kind of project."=20 Starting Monday, the center runway will close for approximately two months= =20 for repaving. Planes will use the airport's two other runways. Tempe=20 spokesman Randy Gross said the city is looking into a hearing that would=20 force Phoenix to conduct environmental studies in compliance with the=20 Environmental Protection Agency and the federal Clean Air Act. No date has= =20 been scheduled. With the injunction, further litigation on the project will= =20 not be successful, Rimsza said. "At some point, it has to end with this=20 continuing saga with Tempe," he said.
