Just because it's legal it doesn't mean it's fair.

For several years having slaves was legal, and yet it was still unfair
for all those people enslaved.

You don't have that freedom under copyright law, but it is fair that you
do have it. The GNU GPL (through the Copyleft concept) uses Copyright to
grant you back that freedom, albeit in a way that forbids you to remove
that freedom at a later stage, which is good and fair.
