The guideline (Code vs Content) says: Game music or audio content is permissible, as long as the content is freely distributable without restriction, and the format is not patent encumbered. Unfortunately, I think that clause 1 is a restriction on distribution, specifically the "complete set" rule. The license is not open source, because of the restriction on "modification", but it doesn't have to be to meet the Content rule here.
