This is complete rubbish and IBM well understands this. It even uses the
same licence for some of its own software:

JFS is IBM code, ported by IBM from OS/2 to Linux.


the only possible licence issue with GPL-licenced code is that if you
provide a changed version to a third party you must also provide, on
request, the source code too. It's a matter considered by IBM legal in
considerable depth over some years.
