Intel HDMI Audio Output

I have recently acquired one of these Mini-ITX boards:

http://www.jetway.com.tw/jetway/system/productshow.asp?id=404&proname=J9F2-Extreme

Most interestingly, it has Intel (945GM) graphics with an HDMI output. I have managed to find out the following about it:

- Chipset appears to be Realtek ALC883

Running a 2.6.23 kernel, I see the following aplay output:

=================================================
# aplay -l
**** List of PLAYBACK Hardware Devices ****
card 0: Intel [HDA Intel], device 0: ALC883 Analog [ALC883 Analog]
  Subdevices: 1/1
  Subdevice #0: subdevice #0
card 0: Intel [HDA Intel], device 1: ALC883 Digital [ALC883 Digital]
  Subdevices: 1/1

And:

=================================================
# cat /proc/asound/card0/codec\#0

I am able to use aplay to send an ac3 file to the device, but I never hear anything on the TV which is HDMI connected.

Following an email to the manufacturers European support representatives, I was asked to try the following custom version of ALSA:

http://www.realtek.com.tw/downloads/downloadsView.aspx?Langid=1&PFid=24&Level=4&Conn=3&DownTypeID=3

I am working on building and trying these drivers, but have a couple of questions in the meantime:

1. Does anyone know what the status of HDMI audio support is (in particular Intel)?

2. Any idea why Realtek are maintaining their own version of drivers? Is this a legal/licensing issue?

TIA
