No need to grab disconnect mutex in chars_in_buffer now that no
sub-driver is or should be querying hardware buffers anymore. (They

Why is this needed in the 3.9-stable tree?  Are you sure all the drivers
are fixed up there?  What bug does this fix?

Because you wanted to apply it to the 3.9-stable tree and asked for a backport? Anyway if you've changed your mind, feel free to drop this.
