Uhm... I didn't mark this patch for stable.

It's based on code changes (support for USB  bulk transfers, conversion
to videobuf2) which didn't make it into kernel 3.8, so it's no surpise
that it doesn't apply.

Although it would be possible to backport this patch for older kernels,
I see no benefit in doing that.
AFAIK, it wouldn't fix any bugs there.
