I have to agree with this logic, if only for the reason that governments are very limited in how they can regulate the Internet (and bravo!). I guess, technically, you can sue someone for stealing (using(?) without the explicit permission of the copyright holder) an image. But such faith in the interoperability of international judicial systems is like watching CSI as a documentary.

But, what can you do? Make your image low res to the threshold of marketability? Slap any variety of watermarks on the image (again, a threshold)? Use www.tineye.com to hunt down your images and send violators stern emails? Issue your image license under the Creative Commons (those communists!). I suppose, to compete as a pro these days, anyone without a sophisticated web presence has a monumental level of challenge before them.

People, for whom such theft represents a financial loss or misrepresentation, have a solid claim. However, anything else simply falls under the auspice of intellectual property. I greatly caution the pursuit of this construct if we ever envision the Internet to be anything more than a celebration of privatization and capitalism.

How accessible is this Flickr group, or the images within? Flickr is a Yahoo! product, and a free one at that. Read the fine print and learn exactly how much integrity your images have in this space. The PF gallery has(d) ZERO limitations on access. I'm fascinated this subject is actually a point of discussion. If anyone on the list has had an image lifted from the Internet, how much money do you claim you lost (if you are willing, or legally able, to discuss)?
