Russ,
I'm not sure you actually have a problem. The background layer always comes up as locked, because you aren't allowed to delete it. You can make changes to it without problem, though I prefer to copy it before starting any alterations--that way the background layer is always there in its original state if I want to start over.
Are you having a problem with other layers, beside the background layer, coming up locked?
