Peer-to-Patent
Dear Reviewers,

We have much to celebrate at this time. With the passage and signing of the America Invents Act back in September, the USPTO is now in position to adopt much of what we have learned from Peer To Patent. According to USPTO Director Dave Kappos, the first step will be to develop and implement a web-based third-party contribution system by September 2012. This will provide the ability to submit prior art electronically much like you are used to with Peer To Patent. To encourage third-party contributions and the use of this system, Kappos indicated that any contributor will be able to submit up to three prior art references with annotations through the web-based system at no cost. This is a dramatic change from existing law which requires the payment of a fee for third-party submitted prior art with no annotations and only in hard copy. Contributors who wish to submit more than three references or who wish to continue submitting in hard copy will likely still be subject to a fee. Of course, all of this is simply proposed at this time and awaits final rulemaking, but the enabling legislation is a direct result of all of your work on the Peer To Patent pilots. 

We still have a bit of work to do on both the UK and US pilots even though we are no longer posting new applications. Please help us complete these pilots by contributing prior art on the last of the posted applications. We will tell you more about our future plans in our December newsletter.

This Issue: Second Annual Prior Art Collaboration Conference
International Participants gather at USPTO

On October 20-21, New York Law School and Queensland University of Technology convened the Second Annual Prior Art Collaboration Conference hosted by the US Patent and Trademark Office. This second international meeting joined those interested in improving our patent systems to discuss what has been happening, the results of the various Peer To Patent pilots, the assessment of participating examiners and how to improve access to prior art through open access.

This Issue: ArchPatent
New Patent Search Tool

Recently, ArchPatent, a free-to-use patent search tool, went live to the public. Developed with the help of many Patently-O readers, by engineers and managers, this resource aims to ease the difficulty in patent searching. As a feature, this resource provides the ability to search through US patent applications, assignments and grants back to 1920 and US patents as far back as 1790. Additional tools also allow filtering, organizing and saving these searches on personal workspaces. Better yet, ArchPatent is mainly supported by ad revenue providing free patent searching for registrants.
