The initial openSUSE 2.6.37-rc2 patched kernel had something similar.

I think they found it to be one of their patches they had forwarded from 2.6.36

Anyway, it was fixed by the core opensuse kernel team I do believe,
but it took a couple days.

So if this is a 2.6.37-rc kernel your trying to compile, I'd start
looking at any ubuntu specific patches for the culprit.  (Or you can
just wait a couple days a try a new set of source.)
