The patch titled
     Fix a lock problem in generic phy code
has been removed from the -mm tree.  Its filename was
     fix-a-lock-problem-in-generic-phy-code.patch

This patch was dropped because it was merged into mainline or a subsystem tree

The following patch fixes it. Tested on an AT91SAM9263-EK board, kernel 2.6.23-rc4 and -rc3-mm1.
