I do not know exactly what userspace bit causes the bug to happen. I got the first bug reports in the past weeks/month from people using debian-testing and arch-linux, using kernel 3.0. I could not reproduce the problem on ubuntu 11.04 (2.6.38&3.0), but fortunately, it triggered when I upgraded to ubuntu 11.10 (3.0) ;-). So backporting it to 3.0 and perhaps 2.6.3[89] will definitely be good. For older kernels it is only needed if they are used in combination with more modern userspace.
